1. Service and assessments
Diaspora Desk arranges on-the-ground observation of lawful projects in Kenya. An accepted job may include photographs, video, location evidence, voice notes, and written observations collected by a scout within an agreed scope.
The website assessment is preliminary guidance. Its category, checklist, staffing, and timing suggestions may require human review and do not confirm a booking, price, availability, access, or completion date.
2. Booking and payment
A job is confirmed only when we accept it and you approve the written scope, deliverables, timing, quote, and payment terms. Unless the accepted quote says otherwise, 50% is due before fieldwork is scheduled and 50% after delivery and review. Changes to the project, access, or urgency may affect price and timing.
3. Verification limits
A report records what a scout could lawfully observe or was voluntarily shown at a particular place and time. It does not guarantee ownership, authenticity, value, quality, legal compliance, future performance, or the absence of fraud or hidden defects.
We do not provide legal advice, title authentication, surveying, valuation, engineering certification, financial auditing, criminal investigation, or a judgment about any person’s honesty. Seek qualified advice before making an important legal, financial, or property decision.
4. Your responsibilities
You must provide accurate details, have a lawful purpose and authority for the request, arrange lawful access, disclose known safety or privacy concerns, and review the agreed scope and report promptly.
You must not request or use the service for:
- trespass, harassment, confrontation, deception, covert recording, or unsafe conduct;
- locating, following, or secretly observing a person;
- photographing a minor or collecting an identity document;
- carrying, receiving, or delivering money or valuables;
- violating another person’s legal, privacy, or property rights; or
- defaming, intimidating, discriminating against, or harming someone.
We may refuse or stop work for legal, safety, privacy, access, coverage, or availability reasons.
5. Concerns and refunds
If a report materially misses the agreed scope, notify us promptly with the job reference and disputed detail. We may clarify, correct, arrange a reasonable follow-up, or provide another appropriate resolution. Refunds depend on the accepted booking terms, work completed, costs incurred, and reason the job could not be completed. Job-specific terms in an accepted quote take priority.
6. Ownership, availability, and liability
The Diaspora Desk name, branding, website design, and original content belong to us. You may use the website normally, but you may not copy or commercially reuse these materials without our permission.
We will provide accepted services with reasonable care and within the agreed scope. To the extent permitted by law, we are not responsible for losses caused by inaccurate information, denied access, circumstances outside our control, or decisions made beyond the factual findings in a report. Our total liability for a paid job will not exceed the amount paid for that job. Nothing in these Terms limits rights or remedies that cannot lawfully be excluded.
7. Law, changes, and contact
These Terms are governed by Kenyan law. If a dispute arises, both parties will first make reasonable efforts to resolve it directly. If it cannot be resolved, either party may pursue the remedies available under Kenyan law.
